Boudoir Fusion Photography Terms and Conditions

Welcome to Boudoir Fusion Photography. These Terms and Conditions form a legally binding agreement between you (“the Client”) and Boudoir Fusion Photography, including the Photographer, Makeup Artist, and any other staff members (“we,” “us,” or “our”). By booking a session or using our services, you agree to be bound by these terms.

1. Booking and Services

By signing this Agreement, you engage Boudoir Fusion Photography to provide photography services in one or more of the following categories:

A non-refundable session retainer/booking fee is required to secure your date and time. The balance of the session fee is due on or before the day of your shoot. No services will be rendered until full payment is received.

The services included in your session are based on the package selected on our official price list, which can be found on our website at www.bfphoto.co.za.

2. Image Use, Copyright, and Intellectual Property

All images taken during your session remain the sole property of Boudoir Fusion Photography unless otherwise agreed in writing. Clients are granted a non-exclusive, non-transferable licence to use the images for personal use only (e.g., on personal social media profiles).

You may not reproduce, edit, sell, or publish the images without our written permission. Any unauthorised use of images will result in a charge of R1,000 per image and potential revocation of your image usage rights.

Boudoir Fusion Photography may only use your images for marketing or promotional purposes with your written consent via a client release form or explicit message. In the event of non-payment, we reserve the right to use your images to recover value owed.

3. Model Release

A signed model release is required only if you agree to let us use your images publicly. If you choose not to grant this, your images will remain private.

4. Cancellations and Rescheduling

All booking fees are non-refundable. Cancellations within 7 days of the scheduled session will incur the full session fee. A rescheduling fee of R1000.00 applies to all date changes made by the client.

5. Limitation of Liability

Boudoir Fusion Photography is not liable for any injuries, illnesses, or damages to personal property incurred during the session or while travelling to or from the location. We are not responsible for loss or damage of images due to camera malfunctions, processing errors, or unforeseen events.

In the case of Force Majeure (e.g., pandemics, natural disasters, or other events beyond our control), Boudoir Fusion Photography will not be held liable for session cancellation, delays, or inability to perform. We will attempt to reschedule when safe and possible, but refunds will not be issued.

6. Privacy and Age Confirmation

Boudoir Fusion Photography does not accept clients under the age of 18 for boudoir, glamour, nude, lingerie, or sensual photography. By booking a session, you confirm that you are at least 18 years of age.

We respect your privacy. Your images are never shared without your consent. For more details, please refer to our Privacy Policy.

7. Editing and Delivery

Images will be edited in our signature style as displayed in our galleries. Final delivery takes 14–21 working days. Coffee table books or printed products may take longer.

We reserve the right to delete any image that does not meet our quality standards, including but not limited to those with poor composition, closed eyes, or unflattering angles.

We will store your edited images for up to one year. High-resolution copies can be purchased separately.

8. Product Orders and Payment

All physical products must be paid for in full before any design or printing work begins. All sales are final. If a payment plan is arranged, no images will be released until payment is complete. Unpaid balances after 30 days may result in images being used by Boudoir Fusion Photography for promotional purposes.

9. Conduct During Sessions

No other photographers or personal cameras are permitted during your session without prior written approval. This includes mobile phones and video devices.

10. Agreement Acceptance

By booking and attending a session, you confirm that you have read, understood, and agreed to these Terms and Conditions. This agreement is legally binding and enforceable under South African law.
