Terms & Conditions

1. Bookings, Packages & Payment

Photography sessions may include boudoir, glamour, lingerie, implied nude, artistic nude, erotic, adult content creator or other agreed photography services.

The services, session duration, number of edited photographs and applicable extras are determined by the package selected and confirmed at the time of booking.

Booking payments:

• Awaken: Full package payment is required to confirm the booking.
• Classic, Ultimate and bespoke sessions: A R2,500 booking retainer is required. This amount is credited towards the total session price.
• Other packages, including Simply You: The booking payment is as stated in your written quotation or booking confirmation.

Unless otherwise agreed in writing, any outstanding session balance must be paid by 09:00 on the morning of the scheduled shoot.

Additional services, upgrades and products are charged according to the prices agreed when ordered. No final images or physical products will be released while payment for those items remains outstanding.

2. Cancellations & Rescheduling

Your booking reserves studio time and preparation specifically for you. If your plans change, please contact us as soon as possible.

Rescheduling: One change of date will normally be accommodated, subject to availability and reasonable notice. Further changes may incur a reasonable administration or rescheduling charge, disclosed before the change is confirmed.

Cancellations: A booking retainer is intended to secure the session date, but any cancellation charge or retention of payments will be limited to an amount reasonable in the circumstances and permitted by applicable law.

Where cancellation occurs within seven days of a session, the charge may be higher because the reserved time is more difficult to rebook. Relevant factors include notice given, work already performed, costs incurred and the opportunity to secure another booking.

No cancellation fee will be charged where prohibited by law, including applicable circumstances involving death or hospitalisation.

If we must cancel a session, we will offer a suitable alternative date or an appropriate refund for services not supplied, subject to applicable law.

3. Copyright & Image Usage

Unless expressly agreed otherwise in writing, copyright in photographs, video material and edited works remains with Boudoir Fusion Photography, to the extent that such copyright is legally owned by us.

Personal boudoir and portrait clients: Once fully paid for and delivered, your finished photographs may be downloaded, printed and shared for your own personal, non-commercial use.

You may share your photographs on personal social media accounts, subject to applicable law and the rights of any other people depicted. Commercial advertising, resale or licensing to third parties requires separate written permission.

A commercial usage licence does not itself transfer copyright ownership. Any copyright assignment must be expressly agreed in writing.

All image usage remains subject to applicable law, platform rules and the rights and consent of people appearing in the content.

4. Privacy, Confidentiality & Model Releases

Your privacy is the default. Booking a photography session does not give Boudoir Fusion Photography permission to publish your photographs.

We will not display, publish, advertise, sell or otherwise use identifiable client images for our own promotional purposes without the client's separate, informed written consent.

Permission may be granted through a signed model release or another clear written agreement specifying the images and intended use. Consent is optional and declining it will not affect your photography experience or the services received.

A client may request withdrawal of promotional consent. We will stop future use and take reasonable steps regarding material under our control, subject to applicable law and any limitations already disclosed.

Non-payment never constitutes permission to publish your images. Outstanding accounts will be handled through lawful payment recovery procedures, not public disclosure of private photographs.

Personal information and photographs are handled in accordance with applicable privacy legislation, including the Protection of Personal Information Act (POPIA). Information is collected and used for legitimate purposes such as booking, photography, editing, delivery and administration.

Necessary information may be shared with service providers involved in fulfilling your booking, subject to appropriate confidentiality and security safeguards.

Requests concerning access, correction or deletion of personal information may be directed to info@bfphoto.co.za . Such requests will be considered in accordance with applicable law.

5. Age, Consent & Session Conduct

All clients and participants in boudoir, lingerie, nude, erotic and adult content creator sessions must be at least 18 years old. Proof of age may be requested.

Participation must be voluntary and consensual. Personal boundaries are discussed before and respected throughout the session.

We reserve the right to refuse or stop any activity that is unlawful, unsafe, non-consensual or outside the scope of the agreed photography services.

Additional photographers, cameras, mobile-phone recording and other recording devices are not permitted during a session without prior approval.

6. Editing, Selection & Delivery

Photographs are professionally edited in the established Boudoir Fusion Photography style, as demonstrated in our portfolio.

The Photographer selects the images suitable for final delivery. Unusable photographs, duplicates, test frames and images that do not meet professional quality standards are not included.

Standard delivery is generally estimated at 14–21 working days after the session, provided outstanding payments and any required selections or approvals have been completed.

Delivery times are estimates rather than guaranteed deadlines unless a specific date is agreed in writing. Printed products may require additional time.

The digital package includes the agreed number of professionally edited, high-resolution images. Additional images, extensive retouching, alternative editing styles and expedited delivery may incur additional charges agreed in advance.

RAW files and unedited photographs are not included unless expressly stated in a separately purchased product or written agreement.

7. Image Storage & Backups

We generally retain delivered edited images for up to 12 months after the session, subject to operational requirements and applicable legal obligations.

Long-term storage is not guaranteed. Clients should download their photographs promptly and maintain their own secure backups.

Where reasonably possible, we will assist with recovery of files still held in our archive. We cannot guarantee that deleted or corrupted files can be restored.

8. Albums, Wall Art & Printed Products

Coffee table books, PhotoBoxes, photographic prints, framed art, canvases and calendars are available as optional products.

Product specifications, dimensions, pricing and included quantities are determined by the order confirmed with the client.

Full payment is required before bespoke design or printing work begins, unless otherwise agreed in writing.

Custom-made products may not be eligible for cancellation or return merely because of a change of mind, where permitted by law. This does not affect statutory rights relating to defective or incorrectly supplied goods.

Minor variations in printed colour, texture and finish may occur because of differences between calibrated displays, printing materials and production processes.

9. Safety, Liability & Unforeseen Events

We take reasonable care to provide a safe, professional photography environment and to protect photographic material.

Clients are responsible for disclosing any relevant safety concerns and for taking reasonable care of their own belongings.

Equipment failure, illness, power interruptions, severe weather or other circumstances beyond reasonable control may occasionally disrupt a scheduled session or delivery.

Where this occurs, we will communicate with the client and seek a fair solution, including rescheduling, replacement services or an appropriate refund where required.

Nothing in these terms excludes liability for gross negligence or limits any statutory remedy or consumer right that cannot lawfully be excluded.

10. Agreement & Governing Law

These terms should be read together with your confirmed package, quotation, booking agreement and any separately agreed commercial licence or model release.

Where a signed agreement contains specific terms for a particular booking, those terms will apply to that booking to the extent that they are lawful and do not conflict with mandatory consumer protections.

These Terms and Conditions are governed by the laws of the Republic of South Africa.

By accepting a quotation, confirming a booking or signing the relevant booking agreement, you acknowledge that these terms have been made available to you.
